Regulation of Courses

Free Courses (Cursos Livres) have as their Legal Basis Presidential Decree N° 5.154, of July 23, 2004, Art. 1° and 3°, and Ordinance (PORTARIA) Nº 008, of 25/06/2002, published in the OFFICIAL GAZETTE – SC – Nº 16.935 – 27.06.2002. The distance learning Free Course is a modality of non-formal education of variable duration, intended to provide the worker with knowledge that allows them to professionalize, qualify, and update themselves for work.

The Federal Constitution in its Article 205/CF, “caput”, provides that education is the right of everyone and shall be encouraged by society.

Such practice is also defended by Article 206/CF which provides that teaching shall be offered based on certain principles, and in its item II: “the freedom to learn, teach, research, and disclose thoughts, art, and knowledge.”

Free Course Law nº 9.394/96 – National Education Guidelines and Bases (LDB) came to integrate the modality of Professional Education.

Professional Education is the modality of non-formal education of variable duration, intended to provide the worker with knowledge that allows them to professionalize, qualify, and update themselves for work. According to Law nº 9394/96, Decree nº 5.154/04, and Deliberation CEE 14/97 (Indication CEE 14/97), the courses called “Free” do not require prior authorization to operate nor subsequent recognition from the competent Education Council. There is no specific legislation that regulates these courses; therefore, Free Courses are not subject to regulation by the Ministry of Education (MEC). There is no requirement for previous schooling. The Free Course category serves the population with the objective of offering rapid professionalization for various areas of activity in the labor market, e.g., Informatics, Customer Service, Secretarial, Webdesign, Security, Languages, Cooking, Cutting & Sewing, Aesthetics, Beauty, etc. Free means that there is no mandatory requirement for: workload, which may vary between a few hours or several months of duration, subjects, duration time, and a previous diploma. Thus, the offering of these courses does not depend on authorizing acts from this Ministry, such as: institutional accreditation, authorization, and course recognition. The schools that offer this type of course have the right to issue a certificate to the student in accordance with Law nº 9394/96; Decree nº 5.154/04; Deliberation CEE 14/97 (Indication CEE 14/97). Note that a Free Course has no link with or recognition by the MEC/CAPES. These Certificates have legal validity for various purposes, but they cannot be validated, convalided, or endorsed by schools recognized by the MEC/CAPES. The jurisprudence of the National Council of Education has been to declare their equivalence, in accordance with broad and flexible rules. Cooperatives, Companies, and Self-Employed Professionals can also offer such courses and issue certificates.
